General terms and conditions of business

These General Terms and Conditions apply to all courses, holiday camps and other services provided by Chess4kids GmbH.

1. Registrations

Registrations can be made online via homepage. They will be considered in the order in which they are received and are binding. With the registration the general terms and conditions as well as any course-specific booking conditions are accepted.

1.1 Registration for semester courses in our course locations

Chess4kids offers semester courses. The course costs are CHF 660.00 per semester. The semesters are based on the cantonal school semesters (winter semester starts after the summer holidays until the sports holidays, summer semester starts after the sports holidays until the summer holidays). No courses are held during the school holidays.
The course fee is to be paid before the start of the course and entitles the participant to attend the respective course. It includes 1 lesson per week and the course material. If a child signs in newly for our classes during the running semester we reduce the fee by CHF 30.00 per lesson missed. For private lessons, monthly invoices are issued at the end of each month.
Siblings receive a 20% discount on tuition from the 2nd child. For every friend you bring to a weekly lesson and who registers bindingly for the semester course in the same semester, you will receive a voucher for CHF 30 for your next courses.
The registration with course place guarantee is automatically extended by a further semester, unless the deadlines specified in the section Cancellation of courses and holiday camps are met.

1.2 Registration for online semester courses

Chess4kids also offers semester courses online. The course costs are CHF 450.00 per semester. The semesters are based on the cantonal school semesters (winter semester starts after the summer holidays until the sports holidays, summer semester starts after the sports holidays until the summer holidays). No courses are held during the school holidays.
The course fee is to be paid before the start of the course and entitles the participant to attend the respective course. It includes 1 lesson per week and the course material. If the child starts during the current semester, the course fee is reduced by CHF 25.00 per lesson already taken. For private lessons, monthly invoices are issued at the end of each month.
Siblings receive a 20% discount on tuition from the 2nd child. For every friend you bring to an online weekly lesson and who registers bindingly for the online semester course in the same semester, you will receive a voucher for CHF 30 for your next course.
The registration with course place guarantee is automatically extended by a further semester, unless the deadlines specified in the section Cancellation of courses and holiday camps are met.

1.3 Registration for holiday camps

Chess4kids offers holiday camps. The holiday camp fees are shown on our homepage and are to be paid before the start of the course. We do not offer sibling discounts for the holiday camps, but you can find early booking discounts on our flyers.

2. Course confirmation and payment of course fees

After the course or camp registration you will receive a confirmation from us. The invoice and payment slip will be sent to the billing address provided. Course and camp fees are due for payment before the start of the course or holiday camp or on the date stated on the invoice. Payment of the course fee entitles you to participate in the course or camp. For private lessons, monthly invoices are issued at the end of each month.
Payment reminders are charged, the first reminder costs 15CHF, the second reminder costs 35CHF.
After the second reminder, the invoice goes into debt collection.

3. Course organization, participants and implementation

For organisational reasons, individual courses may be postponed or combined. The participants concerned will be informed in time. If necessary Chess4kids can change the course leader or appoint substitute. Such changes generally do not entitle the participant to withdraw from the course or reduce the course fees.

If there is insufficient demand or for other organisational reasons, a course or holiday camp may be cancelled. The registered participants will be informed in time and will get back the paid course fees. Chess4kids does not assume any further obligation for compensation. There is no obligation to reimburse as a result of short-term losses due to epidemics, pandemics, disasters, unrest and armed conflicts. In such cases Chess4kids can offer alternative services (online hours and online camps) if possible. We reserve the right to exclude children from the class that fail to comply with rules despite repeated warnings without refunds. Occasionally we photograph our kids during chess training and tournaments. The photos are mainly used as illustrative examples of our brochures and homepage in order to report about our events and show the parents about the activities of their kids. Please send us an e-mail if you do not agree with this approach.

4. Deregistration, rebooking and withdrawal

A cancellation must be made in writing by post to the business address or by email to info@chess4kids.ch. The cancellation is valid from the date of receipt by Chess4kids. Non-payment or non-appearance of the course fee does not constitute cancellation and the course fee remains due.

4.1 Semester courses

Cancellations of semester courses must be submitted in writing by 31 May (for the winter semester) or 20 December (for the summer semester) by email to info@chess4kids.ch. Withdrawal is only possible at the end of the semester by written notification to the school management (by post or email: info@chess4kids.ch). Otherwise the membership and thus the payment obligation is extended by one semester. In case of cancellation after the beginning of the semester, no refund of the paid amount is possible or the course fee remains due 100 percent.

4.2 Holiday camps

The invoice sent together with the confirmation of registration is payable by the specified date before the start of the camp and thereafter entitles the participant to attend the selected holiday camp. The following fees will be charged for cancellations:

Deregistration time and cancellation fees

Up to 22 days before the start: CHF 100 processing fee

15 to 21 days before the start: 50 % of the course fee

From 14 days: 100 % of the course fee

In case of later cancellation or withdrawal after the course has started, 100% of the course fees are due.

4.3 Rebooking semester courses and camps

Rebookings are free of charge up to 4 weeks before the start of the course or camp. From 4 weeks before the start of the course/camp, a processing fee of 100CHF will be charged. For rebookings less than 2 weeks before the start of the course/camp, the full amount is due. If the course or camp can be carried out with the minimum number of participants despite the rebooking and the newly agreed course or camp is actually attended, these costs are waived.

4.4 Cancellation of semester courses and camps

In the event of withdrawal from a current course or holiday camp, there is no entitlement to repayment of the costs or part thereof or the outstanding course/camp amount remains due in full. In cases of hardship and on the basis of a written request to our email info@chess4kids.ch, in exceptional cases it is possible to deviate from the regulations under point 5. In any case a handling fee of CHF 100 will be charged.

5. Missed course days/lessons

5.1 Semester courses

The right to attend the booked course is personal and non-transferable. Lessons not attended due to illness, holidays, etc. do not entitle the participant to a reduction in course fees. Missed lessons can be made up for in another class during the semester in consultation with the trainer. Lessons can only be made up in the following semester if the following semester has been paid for.

5.2 Holiday camps

Missed camp days and lessons can generally not be made up. The course fee will not be reduced due to missed camp days/lessons. However, in individual cases we offer the possibility to compensate missed days/lessons at a later date upon request.

6. Liability and insurance

For all courses and holiday camps and events organised by Chess4kids, Chess4kids excludes all liability, including liability for accidents or loss or theft of property. Course participants are responsible for ensuring that they have sufficient insurance cover.

7. Changes

We reserve the right to make changes compared to the course announcement, such as program and price changes, which must be made in writing. We also reserve the right to make changes to the General Terms and Conditions of Business (GTC), which can be put into effect at any time without prior notice. Should one of the preceding provisions not be applicable, the validity of the remaining course conditions remains unaffected. Course descriptions are part of the general course conditions.

8. Data protection

The data collected in the course registration process will be treated confidentially. They are used exclusively for internal purposes and are not passed on to third parties.

9. Applicable law, place of jurisdiction

Swiss law is applicable to all legal relationships with Chess4kids. Place of jurisdiction for claims against Chess4kids is exclusively Zurich.

10. Entry into force

This version of the General Terms and Conditions shall apply to all course registrations and orders from 1 April 2020.
